A defendant shall be punished by imprisonment for not more than ten months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On August 13, 2014, the Defendant was sentenced to two years of imprisonment with prison labor in the Seoul Northern District Court for fraud, etc. and the judgment was finalized on August 21, 2014.

1. In collusion with C (Suspension of Prosecution) on August 23, 2011, the Defendant: (a) at the F Company’s office operated by E (1301) in Jung-gu Seoul Metropolitan Government on the location where real estate was indicated through E; (b) through E, the Dobong-gu Seoul City H2F in the name of the location where real estate was indicated; (c) the deposit column in the deposit column (Won 60,000,000) is paid and received at the time of contract; (d) in the deposit column, the Defendant paid the deposit amount at KRW 6,00,00 (6,00,000) at the time of contract and received; and (e) in the balance column, the amount of money KRW 54,00,000 (54,00,000) was paid on October 8, 201; (d) on the name and address of the lessor in the Dobong-gu Seoul Metropolitan Government on the name and address of the lessee, the name and address column 1, “O-M-1,” in the name and column 4.

2. On August 23, 2011, the Defendant: (a) in collusion with C, requested the victim G to lend money in the name of the said F Company’s office via E; (b) it falsely stated that C, “I would provide a loan contract of KRW 60 million as security; and (c) would pay monthly interest of KRW 40 million and pay principal within three months; and (d) the Defendant, as seen above, provided that C would pay a forged lease contract of KRW 40 million as security.

However, the actual lease deposit of the defendant was only five million won, and the lease contract was forged.

The defendant, in collusion with C, deceives the victim and is subject to such deception.
