1. The plaintiff's claim is dismissed.
2. The defendant shall pay to the plaintiff succeeding intervenor KRW 31,824,006 and KRW 29,435,956 among them.
Reasons
1. The plaintiff's successor's claim
A. Indication of Claim: In addition, the Plaintiff’s claim against the Defendant was created as indicated in the grounds for the claim (However, “creditor” and “debtor” are deemed as “Plaintiff” and “debtor” as the Defendant). On May 20, 2016, the Plaintiff’s succeeding intervenor received the claim against the Defendant from the Plaintiff on May 20, 2016 during the instant lawsuit.
(b) Applicable provisions of Acts: Article 208 (3) 3 of the Civil Procedure Act;
2. As seen earlier, the Plaintiff transferred his claim against the Defendant to the Intervenor during the proceeding of the instant lawsuit, and thus, the Plaintiff’s claim is dismissed.
