Defendant
A is a person who operates a food material supplier company of "F" in Changwon-si Msanpo-si E, and Defendant B is a person who is an employee of F in charge of business, such as transportation of food materials and bid for high-quality local meal service contract, as the Dong book of Defendant A, and Defendant C is a person who operates a food material supplier company of "H" in Gyeongnam-gun G.
1. Defendant A and Defendant B suggested that Defendants C participate in the bidding in the form of a joint principal tender in order to establish “L” with the location of the place of business in the form of Defendant B’s wife J in order to receive a successful bid for school meal service incidental supply contract ordered by an Ihigh school in the form of a lowest successful bid, and to prevent a failure to meet the number of participating companies in the bidding, and Defendant C agreed that the above two companies will be reflected in the bidding, and that the Defendants received a successful bid in the name of the above two companies, and the supply of food materials was recruited to F.
According to the above public offering, Defendant A participated in the “M” tender around August 31, 201, prepared and delivered to Defendant B a bid under the name of H indicating L’s tender, bid bond payment undertaking, and bid amount set at a higher level than L, and a bid bond payment undertaking, and Defendant B was awarded a bid in the name of L from February 27, 2014, including the bid price of KRW 35,80,000 for L under the name of H rubber plates and Defendant B’s seal impression on the H tender document with a seal affixed. Defendant B was awarded a bid of KRW 806,049,300 for a total amount of KRW 23 times from that time until February 27, 2014 in the same manner as indicated in the attached list of crimes (i).
Accordingly, the defendants are to purchase meal goods ordered by the I High School in collusion in order to set the amount of each bid of L and H in advance and to cover it.
