1. The Defendant’s KRW 200,000,000 as well as the Plaintiff’s annual rate of 5% from March 2, 2015 to August 13, 2015.
Reasons
1. Indication of claim;
A. On October 20, 2013, the Plaintiff leased KRW 200,000,000 to the Defendant on March 1, 2015, and the Defendant issued and delivered the loan certificate to the Plaintiff on the same day.
B. Therefore, as the Plaintiff seeks, the Defendant is obligated to pay to the Plaintiff 200,000,000 won and damages for delay calculated at the rate of 5% per annum prescribed by the Civil Act from March 2, 2015 to August 13, 2015, which is the delivery date of the payment order of this case, and 20% per annum prescribed by the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from the next day to the day of full payment.
2. Judgment by service (Article 208 (3) 3 of the Civil Procedure Act).
