A A shall be punished by a fine of 900,000 won, by a fine of 2,00,000 won, and by a fine of 800,000 won.
Reasons
Punishment of the crime
1. Defendant A and Defendant B were candidates for the IF election of the head of the IFC, which was implemented on December 28, 2011, and were not provided pecuniary or other property benefits to members from 180 days before the expiration date of the term of validity of the president of the association to the election day, and Defendant B was prohibited from doing any such act for a candidate in connection with the election
Nevertheless, the Defendants conspired to carry out an election campaign by providing members with 50,000 won cash, and the Defendant A put 50,000 won in M in the house of the members of the J at the end of November 201, 201, stating that “The president of the YJ at the end of the Dong-dong-si, the president of the YJ at the end of November, 201,” and put in K Chapter 3 of 50,000 won in K’s locked, and Defendant B said that “A makes a request from the members of the Y at the beginning of December 201, 201,” and put in Chapter 50,000 won into M’s locked.
From the end of November 201 to the beginning of December 2011, the Defendants provided 70,000 won totaling 50,000 won in cash under the same name among the six members, as shown in the List of Crimes (1).
As a result, the Defendants conspired to provide the members with money equivalent to the above amount.
2. Defendant A
(a) No person who intends to become an officer of an agricultural cooperative in violation of the Agricultural Cooperatives Act shall visit the members of the agricultural cooperative door to door for an election campaign from 90 days before the expiration date to the election day;
Nevertheless, the Defendant, as described in the preceding paragraph at the end of November, 201, visited the house of 3 members for an election campaign, such as the list of crimes (2) as shown in the attached Table, from around that time to December 2011, by finding the house of members K and requesting support while offering cash to K, and also visiting the house of 3 members for an election campaign.
(b)Any teacher violating the Agricultural Cooperatives Act shall be provided by the Act in connection with the election of the president of the Agricultural Cooperatives.
