A defendant shall be punished by imprisonment for four months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
C as an operator of “D”, a person in charge of arranging illegal issuance of U.S. visa, by recruiting disqualified persons for issuance of U.S. visa and collecting fees for forgery of documents, and E is the head of “D” and is a person who forges documents necessary for issuance of U.S. visa under the direction of Defendant C, as the head of “D.”
The Defendant requested C to issue the U.S. visa in a normal way due to absence of certain occupation and income, thereby making it difficult for C to issue the U.S. visa in a normal way. C, E forged documents necessary for issuing the U.S. visa, and the Defendant had expressed his intent to issue the U.S. visa in an unlawful manner, submitting the documents to the Embassy of the U.S. in Korea and making false answers at the visa interview.
1. Forgery of an official document;
A. On October 2015, in collusion with C and E, the Defendant entered “A” in the name column of income certification, “A” in the issuance number column, “A” in the corporate name for the year-end year-end employment income (type A) year-end employment income in the “G”, “H” in the business registration number column, “H”, and “H” in the total amount of income from 2012 to 2014” in the total amount of income from 2014, “5,103”, “4,974,771” in the total amount of the final tax amount of income from 2012 to 2014” in the total amount of the final tax amount of income from 2012 to 2014.
Accordingly, the defendant, in collusion with C and E, forged one copy of the income certificate of the defendant under the name of the Incheon Tax Office, an official document for the purpose of exercising.
B. The Defendant committed the crime of forging the I’s income certificate in collusion with C, E, using the type of income certificate stored in the computer at the above time, place, etc. in collusion with C, “I”, “5385-563-40-118” in the issue number column, and “I” through “the issuance number column”, and “the amount from 2012 to 2014.
