1. Defendant B Co., Ltd.: (a) KRW 29,486,400 for the Plaintiff and the period from January 1, 2017 to January 26, 2018.
Reasons
1. Basic facts
A. On December 30, 2007, the Plaintiff entered into a lease agreement with the Defendant on December 30, 2007 under which the term of lease was 12 months from December 30, 2008, lease deposit was 20,000,000 won, monthly rent was 1,40,000 won (payment on December 30, 200), value-added tax and management expenses (390,000 won).
The Defendant Company paid 20,000,000 won to the Plaintiff around that time, and occupied and used the above 403 office from the Plaintiff.
B. On April 25, 2013, when the Plaintiff and the Defendant Company impliedly renewed the above lease agreement, the term of lease for the above 403 office was 24 months until March 30, 2015, and the other conditions entered into the same lease renewal agreement with the same content.
(2) The Plaintiff and the Defendant Company agreed to set management expenses to KRW 310,200, including value-added tax, from February 2014.
C. As the Defendant Company failed to pay the instant rent under the instant lease agreement, the Plaintiff demanded the Defendant Company to pay the overdue rent, etc. by August 30, 2014, but failed to pay it. At the time of the Defendant Company’s establishment, the Defendant C, a representative director of the Defendant Company, drafted a letter of undertaking to pay the Plaintiff a sum of KRW 30,688,600, including overdue rent, as indicated in the attached Table (hereinafter “instant letter”).
Defendant C transferred 210,00 shares and management rights of Defendant C to E on February 4, 2015, and E was appointed as the representative director of Defendant C’s company on February 4, 2015.
E. Until December 2015, Defendant Company paid to the Plaintiff KRW 3,860,00 on October 2, 2014; KRW 7,835,200 on March 4, 2015; KRW 14,695,200 on September 18, 2015; and KRW 14,695,200 on December 1, 2015 in the name of G; and KRW 80,00 on December 30, 2015 in the name of the Defendant Company.
F. The Plaintiff and the Defendant Company terminate the instant lease agreement around January 1, 2016.
