Reasons
Punishment of the crime
In the election of the 20th National Assembly members implemented on April 13, 2016, the Defendant was a volunteer of E who was released to the 3rd National Assembly member as a candidate for the 20th National Assembly member and won in election, and was in charge of election campaign using SNS. From around April 2015, the Defendant opened and managed a page in the name of the F organization (hereinafter “F”), and around May 2015, the Defendant was also in parallel with off-line activities, such as holding a meeting in the restaurant located at H at P at P at P at P at P at P at P at P at P at P at P at P at the end of December 2015, and around February 20, 2016.
Any private group of individuals, such as native folks society, relatives' society, alumni association, alpine society, etc., and fraternity group, etc., shall not be allowed to carry out an election campaign in the name of such organization.
Nevertheless, on February 19, 2016, the Defendant: (a) posted a video image in the above F name to the effect that “The fact that the candidate returned the name of the candidate to the voters and that he / she sees the fact that he/she / she / she was able to look at; (b) he/she reported the fact that he/she / she / she was able to change the recorded number of candidates; and (c) posted it on the same website on February 22, 2016, etc. to the effect that “The fact that he/she returned the name of the candidate to the voters and that he/she / she was able to look at the E candidate; and (d) posted it under the name of the E-candidate, the fact that the E-candidate / her will be true, and that he/she will be new with the right holder,” and promotional activities in the name of the E-candidate.
Accordingly, the defendant carried out an election campaign in the name of a private group among individuals.
