Reasons
1. Basic facts
A. (1) The Plaintiff is a legal couple on May 9, 1995, who is engaged in the interior business and commercial building lease business, and reported marriage with Defendant B.
(2) The defendant C is the defendant B's counsel. (3) The defendant C is the defendant B's counsel.
B. On May 14, 2012, Defendant B’s deposit account (attached Form Nos. 1 through 3 (1) of the Plaintiff’s Form D deposited account (attached Form No. 1 to 3), the Plaintiff deposited KRW 70 million from the Gannam Bank account under the name of the wife E as a check, and on the same day, the Plaintiff opened a fixed deposit account in the name of the Defendant B at the same pan-dong branch of the Han Bank Co., Ltd. (hereinafter “I Bank”) as indicated in the attached Table No. 1 and 2.
(2) On May 23, 2012, D terminated the deposit account in the name of fatherF at the same branch of Han Bank, one bank, and the deposit amount of KRW 150 million, out of the deposit amount of KRW 2550 million, and opened the account in the name of Defendant B (hereinafter “instant third deposit”) and opened the account in the name of Defendant B with the remainder of KRW 100 million as shown in the deposit table No. 3, as shown in the separate deposit list No. 3, and the F (hereinafter “the deceased”) died at around 17:37 on the same day.
(3) The Plaintiff received a decision to temporarily dispose of the claim under this Court’s 2013Kadan1689 with respect to the claim for deposits Nos. 1 through 3 of this case, and on June 24, 2013, the Han Bank served with the above decision on September 24, 2013, on the ground that it was not possible for the Plaintiff or Defendant B to have the deposited person deposited KRW 207,456,583 in total of the principal and interest of the claim for deposits Nos. 1 through 3 of this case on the ground that the deposited person was the Plaintiff or Defendant
(No. 1527 of this Court, 2013, hereinafter referred to as “instant 1527 deposit”)
On January 16, 2013, Defendant C terminated the savings account in the name of the principal at the Myan City Office in Han Bank (Attached Nos. 4 through 7 of the Deposit List).
