Reasons
Punishment of the crime
The Defendant is an employer who runs a construction business using 40 full-time workers under the trade name of “D Co., Ltd.” in Seongbuk-gu, Sungnam-si.
When an employee retires without an agreement on the extension of the due date for payment between the parties concerned, the employer shall pay all the money and valuables, such as wages, within fourteen days after the cause occurs.

1. The Defendant did not pay the money set forth in subparagraphs 2 through 11, 13, 26, and 28 of the attached Table, including the 1,440,000 won of E’s wage in May 1, 2013, working at the said workplace from April 1, 2013 to May 10, 2013, within 14 days from the date of retirement without an agreement on the extension of the due date between the parties concerned.
2. The Defendant did not pay KRW 2,594,046 of F retirement pay from December 31, 2010 to January 3, 2013 at the same place of business within 14 days from the date of retirement without an agreement between the parties on the extension of the due date for payment.

3. The Defendant did not pay the amount stated in the attached Form 3 through 5, 11, 13, 14, 20, 23, and 29 within 14 days from the date of his/her retirement, without any agreement on the extension of the due date for payment between the parties concerned, as well as the amount of KRW 1,100,00 for the monthly wage of June 1, 2013, G, who worked in the said workplace from June 1, 2013 to June 21, 2013.
4. The Defendant did not pay the amount of KRW 935,724 of the employee H’s retirement allowance within 14 days from the date of his/her retirement, as stated in paragraph 27 of the attached Table at the above workplace, without any agreement between the parties on the extension of the due date.

5. The Defendant did not agree on the extension of the payment term between the parties, without any agreement between the parties on the I’s wage of 2,758,960 won for May 1, 2013 and September 30, 2013; wage of 5,434,720 won for September 2, 2013; income tax and social insurance premium of 239,880 won for July 239, 2013; and 239,880 won for August 239,89,760.
