1. Of the part against A in the judgment of the court of first instance, the part against A pertaining to the payment order shall be revoked.
Reasons
1. The argument about the limitation of liability among the grounds for appeal by the plaintiffs and the defendant as to this part of the liability for damages is not significantly different from the argument in the court below, and the judgment of the court of first instance as to the limitation of liability is just even if all evidence are reviewed together.
Therefore, this court's reasoning is the same as that of the corresponding part of the judgment of the court of first instance. Therefore, this court's reasoning is acceptable in accordance with the main text of Article 420 of the Civil Procedure Act
2. The grounds for this part of the scope of the liability for damages are as stated in the judgment of the court of first instance, except for the parts which are dismissed or added as follows, and thus, they are cited as they are in accordance with the main sentence of Article 420 of the Civil Procedure Act.
[Supplementary or additional parts] A statement of calculation of damages in attached Form of the judgment of the court of first instance shall be applied to the calculation table of damages in attached Form of the judgment of the court of first instance.
The part 3rd 19th 2 of the judgment of the first instance court and the part concerning the period of operation are as follows. 2) The defendant asserts to the effect that the income and the period of operation falls short of the plaintiff's actual statistical income, and thus, the defendant shall calculate the passive amount of damages based on urban daily wage. In the damages compensation case due to tort, the victim's actual income may be calculated based on the victim's actual income at the time of the accident, and it may be assessed based on the presumption income including statistical income. If the victim has obtained a certain amount of income, if there is no evidence of the reliable actual income, the victim's actual income shall be calculated based on statistical income of the person who is engaged in the type of occupation similar to the one for which the victim was engaged (see Supreme Court Decision 2005Da16904, Mar. 9, 2006; and the reported amount of income to the tax authorities is significant in light of the plaintiff A's occupation, age, career, etc.
