A defendant shall be punished by imprisonment for a term of one year and two months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant, along with C, D, E, F, and G, runs a side business without registering with the competent authorities by means of making false sales slips and lending funds, pretending that the Defendant sold goods or provided services by using credit cards from the clients, and without registering with the competent authorities. The Defendant and G ordered C, D, C, and D to prepare sales slips in the name of a credit card merchant, such as “H” and “I,” established in Thailand. In addition, the Defendant and G sent funds to the clients for lending, and the credit card solicitation books, such as F, etc., take charge of collecting and sending the credit cards of the clients for lending from the credit card solicitation books, such as F, K, etc., and sent them to C, and then returned the remainder of the amount calculated by deducting the fee, out of the amount settled by the credit card, and then delivered them again to F, C, and C, having drawn up a false credit card slip with the Defendant and E, and then released money from the Defendant and E, in order to receive money from each other.

In collusion with C, D, E, F, and G on August 4, 2009, the Defendant in violation of the Act on Specialized Credit Financial Business: (a) prepare a false sales slip under the pre-sale as if he/she sold the goods of KRW 1,336,508 using the card terminal in the name of K (L) under the name of K where the credit card solicitor, such as F, was offered at the site of Thailand; (b) make a false sales slip under the pre-sale of the total amount of KRW 1,29,588, which is the remainder after deducting 106,920,000,000 won from 8%, from around that time to May 14, 2010; and (c) prepare a false sales slip under the attached Table 1,039,492,417,797,797,97,97,97, etc. on total amount of KRW 1,039,00.
