A defendant shall be punished by imprisonment for six years.

The defendant shall be ordered to complete the sexual assault treatment program for 40 hours.

Punishment of the crime

On May 8, 2012, the Defendant: (a) around 03:30 on May 8, 2012, at the studio where the Victim E (A, B, age 29) resides in Seocho-gu Seoul Metropolitan Government, the Defendant: (b) opened the entrance door of the victim by advertising the studio; and (c) opened the entrance door of the victim by using the acquired key.

피고인은 피해자가 피고인의 인기척 소리에 깨어난 것을 알아채고, 피해자 쪽으로 다가가 그곳에 있던 이불로 피해자의 얼굴을 가리고, 피해자에게 “조용히 해라, 소리 지르지 마라”라고 위협하여 피해자의 상의를 올려 피해자의 가슴을 입으로 빨다가 피해자가 소리를 지르며 살려달라고 하자, 책상 위에 있는 흉기인 과도(길이 19.5cm, 칼날길이 9.5cm)로 피해자의 배꼽부위에 칼날 뾰족한 부분을 가져다대고 “내가 칼을 들고 있는 거 알지 않냐, 조용히 안하면 칼로 자를 수도 있고, 찌를 수도 있다, 난 살인까지 가고 싶지 않다”라고 협박하여 반항을 억압한 후, 피해자의 바지를 내려 손가락을 피해자의 음부에 넣고, 바지와 팬티를 벗긴 후 피해자의 음부를 혀로 빨고, 피해자의 손을 당겨 피고인의 성기를 만지게 하다가 이불을 조금 치우고 피해자의 입에 성기를 집어넣으며 빨라고 하였으나 피해자가 제대로 하지 못하자 피해자의 양쪽 다리를 벌리고 피해자의 음부에 피고인의 성기를 삽입하여 강간하였다.

Accordingly, the defendant threatened with a deadly weapon and raped the victim.
