1. The plaintiff (appointed)'s claim is dismissed.
2. The costs of litigation shall be borne by the plaintiff (appointed party) and the selected party.
Reasons
1. Facts of recognition;
A. 1) B Co., Ltd. (hereinafter “B”).
(2) On June 20, 1995, the Changwon District Court, Seoul Metropolitan City, Seoul Metropolitan City, 7,281 square meters, D large 149 square meters, E large 53 square meters, had completed each registration of transfer of ownership with respect to the No. 18727, F large 74 square meters, G large 149 square meters on June 9, 1998 (hereinafter referred to as the “instant land”), and the registration of transfer of ownership is completed with respect to the No. 7919 on June 9, 1998 with respect to the No. 1442, the Changwon District Court, Seoul Metropolitan City, Seoul Metropolitan City, and the parcel number shall be indicated as the parcel number, if necessary.
2) 2) B newly constructed the H building on the instant land (hereinafter “instant building”) and completed the registration of initial ownership on August 25, 1997 by the Changwon District Court, the Namhae District Court, as the receipt No. 11565 on August 25, 1997.
3) On November 17, 1997, B established a site ownership of the instant building with respect to each of the instant shares of 3,537/7,281 on November 17, 1997, but changed to each of the instant shares of 3,314/7,281 on December 28, 1998, and the remainder of 3,967/7,281 shares remain as owned by B. Serial 1,586.8/7,281 on May 31, 2006; 586.8/7,281 on June 13, 2006; 206.6.6.6.4 of the Seoul District Court and 7.6.6.6.4 of the receipt and sale of the instant shares, as owned by the Seoul District Court No. 7493, Jun. 13, 2006; 206.37.436.64 of the receipt and sale of the instant shares, 194.7.7.6.6.4
5) On March 30, 2012, KF Capital Co., Ltd. sold 476.04/7,281 shares of the instant land to CFE Roster, Inc. on March 30, 2012. On May 14, 2012, Changwon District Court completed the registration of ownership transfer under the receipt No. 6387 of the receipt on May 14, 2012. 6) I acquired ownership of shares of C land owned by CFE Roster, Inc., Ltd., through public sale on November 5, 2014.
