Reasons
Punishment of the crime
[criminal history] On January 24, 2017, the Defendant was sentenced to imprisonment of one year and eight months with prison labor by night intrusion theft, theft, etc. at the Jeju District Court on January 24, 2017, and completed the execution of the sentence at the Net Prison on May 28, 2018.
[Criminal facts]
1. On July 6, 2018, the Defendant: (a) opened a door to the “E” restaurant operated by the victim D in Jeju-si; (b) opened the door to the restaurant; and (c) intrudes into the restaurant; and (d) collected KRW 10,000 in cash, which is the victim’s possession, kept in the depository of the said depository at the relevant place.
As a result, the theft was committed.
2. On July 11, 2018, at around 05:00, the Defendant opened a door to the “H” restaurant operated by the victim G in Jeju-si, and intrudes into the restaurant, and then takes up KRW 120,000,000 in cash kept in one PC and in the safe, the market value of the victim’s possession on the restaurant.
As a result, the theft was committed.
3. 피고인은 2018. 7. 17. 04:39 경 제주시 I에 있는 피해자 J이 운영하는 ‘K’ 컴퓨터 판매 수리 점에 이르러 잠기지 않은 창문을 통하여 점포 안으로 침입한 다음 시가 300,000원 상당의 컴퓨터 본체 1개, 시가 합계 320,000원 상당의 외장 하드 3개, 시가 합계 200,000원 상당의 일반 하드 5개, 시가 합계 210,000원 상당의 USB 7개, 시가 34,000원 상당의 블루투스 이어폰 1개, 시가 미상의 어댑터 2개, 시가 미상의 모니터 케이블 1개, 시가 합계 150,000원 상당의 향수 1개와 로션 1개, 시가 150,000원 상당의 전 동 드라이버 1개, 시가 60,000원 상당의 수동 드라이버 1 세트, 시가 합계 180,000원 상당의 공구가방 2개, 시가 960,000원 상당의 금반지 1개를 가지고 가 절취하였다.
4. On August 15, 2018, around 05:15, the Defendant: (a) opened an unlocked window at around the point of “N” operated by the victim M in Jeju L at around 05:15; and (b) intruded into the control unit; and (c) intruded into the control unit; and (d) cash, which is the victim’s possession stored in the foregoing credit cooperative at the same place.
