1. The defendant shall pay 63,00,000 won to the plaintiff and 10% per annum from June 21, 2020 to the day of complete payment.

1. The Plaintiff lent a total of KRW 75 million to the Defendant from December 5, 2018 to May 28, 2019. However, the Defendant repaid a total of KRW 12 million to the Defendant, and thereafter, the Defendant, on December 9, 2019, requested the Plaintiff to pay the remainder of KRW 63 million to the Plaintiff on December 9, 2019, issued a loan to the Plaintiff on December 20, 2020, interest rate of KRW 63 million per annum, interest rate of KRW 10% per annum, and interest payment date of KRW 20,000,000 to the Defendant on December 20, 2020, and at once every month on December 20, 201. However, the Defendant delayed paying interest after the payment of interest, and the Plaintiff, on February 8, 2020, issued a loan to the Defendant on December 9, 202.

The fact that up to September 1, 200, the Plaintiff sent a certificate of content demanding the payment of the principal of the borrowed amount and the interest amount of KRW 64,050,000,000 for the above-mentioned interest may be recognized in full view of the overall purport of the pleadings. The Plaintiff is a person who received all interest or delay damages from the Defendant until June 20, 2020 for the above 63 million won.

2. Therefore, the defendant is obligated to pay to the plaintiff 63 million won with interest rate of 10% per annum under the agreement from June 21, 2020 to the date of full payment. Thus, the plaintiff's claim is justified and it is so decided as per Disposition with the assent of all participating Justices.
