A defendant shall be punished by imprisonment for not less than eight months.
Of the facts charged in the instant case, each of the assaults and special intimidation shall be acquitted.
Reasons
Punishment of the crime
The Defendant is a person who resides in the Gangseo-gu Seoul Metropolitan Government “D” dan and operates a mutual news report room, and the victim F (n, 20 years of age) was a person who was employed by the Defendant.
1. Suppression;
A. On October 12, 2016, the Defendant: (a) demanded a victim to borrow money in the Gangseo-gu Seoul Metropolitan Government “D” Gacca room in the Gangseo-gu Gaca in Seoul, on a new wall time; (b) however, the victim refused to do so; (c) it seems that the victim would have expressed his/her desire to do so; (d) “I will receive a loan in 2 weeks; (e) he/she will pay it after the completion of the day; and (e) he/she received a loan counseling using a mobile phone from the victim at around 09:00 on the same day; and (e) at around 15:52 on the same day, the Defendant received the victim’s Haca from the G bank to the bank account of the victim at KRW 9 million; and (e) at around 16:14 on the same day, he/she instructed the victim to immediately withdraw the money; and (e) received it by allowing the victim to withdraw KRW 900,000 from the cash store.
B. The Defendant: (a) around 09:00 on October 14, 2016.
The victim requested the victim to obtain additional loans in the same manner as in the same place as in the same manner as in the same paragraph, but the victim refused to grant the loan to the victim, "I will be able to do so..... why you will be able to do so," and as the victim will be able to do so at the risk of snow, it threatens the victim, which is fright, to have a loan of KRW 7 million on October 14, 2016, and then received the loan from I Bank, and the loan was paid to the victim.
C. On October 17, 2016, the Defendant: (a) threatened the victim in the same manner at the same place as the preceding paragraph; (b) caused the victim to obtain a loan of KRW 5 million on October 17, 2016 from a J bank; and (c) upon deposit of the loan, received the payment from the victim.
