Reasons
Punishment of the crime
1. Defendant A
A. The Defendant: (a) served as a site warden at the construction site at the construction site at the construction site at the Yeongdeungpo-gu Seoul Metropolitan Government Cheongju-gu Cheongju-gu D, and (b) on September 2012, in order to enable E to receive unemployment benefits, the Defendant prepared a false document as if the above E had worked at the construction site and submitted it to each construction company.
For the foregoing reasons, the Defendant submitted a false application for recognition of contractor qualification to a public official who is in charge of being aware of the fact at the Cheongju Employment Welfare Center located in 642 (Songdong-dong) in the Cheongju-gu, Nowon-gu, Seoul Special Metropolitan City around December 16, 2013, as if he had worked at the above construction site, and attempted to obtain KRW 3,149,260 from December 23, 2013 to March 22, 2014, as well as to have the supply of KRW 3,149,260 from March 22, 2014 as job-seeking benefits. From that time to February 16, 2016, the Defendant prevented a public official who received eight times more than 11 times as shown in the list of crimes in the attached Table 1 second to February 16, 2016 from that time to commit the crime of receiving KRW 28,907,430 as benefits.
(b) No one shall receive unemployment benefits by fraud or other improper means;
Nevertheless, the Defendant, by means of reporting false workers, as described in Section 1-A (a) and having them receive KRW 3,149,260 from December 23, 2013 to March 22, 2014 as job-seeking benefits, and, from that time, up to February 16, 2016, eight recipients received the unemployment benefits of KRW 28,907,430 for up to 11 occasions as shown in attached Table 1 for the crimes committed during the period from February 16, 2016.
Accordingly, the defendant could facilitate a criminal act that illegally receives unemployment benefit of 28,907,430 won, and the defendant prevented it.
2. Defendant B
A. On February 2014, the Defendant was working as an on-site warden performed by F (State) at the construction site and did not actually work at the H construction site, etc. when the Defendant’s wife G (State) performed by F (State), but did not work at the H construction site.
