Defendant shall be punished by a fine of three million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

[2019 Highest 482] On November 8, 2018, the Defendant made a false statement to the effect that, at his/her own residence located in the Daegu Jung-gu Gowon B Gowon C, the Defendant would deliver the World Cultural Products Right if he/she sent money to the victim F, who reported and contacted this article, by means of smartphones, to the Internet portal site D (E) car page.

However, the facts are that the Defendant did not own the above cultural products right, and there was no plan to obtain and deliver it. Thus, even if the Defendant received the payment from the victim, he did not have the intent or ability to deliver the above goods to the victim.

Nevertheless, the Defendant: (a) by deceiving the victim as above, received KRW 90,000 from the victim to the G account (Account Number: H) in the name of the Defendant for the purchase price of the World Cultural Products; and (b) received a total of KRW 12 times from around that time to November 26, 2018, a total of KRW 629,000 from the victims, as shown in attached Table 1.

[2019 Highest 791] Around November 30, 2018, the Defendant posted a letter to the effect that he/she would sell online D'I's books on the bulletin board of the Internet D'I', and the Defendant made a false statement to the effect that he/she would send money to the victim J who made contact.

However, there was no intention or ability to send things even if the defendant did not have any things to send them to the victim, and received money from the victim.

As above, the Defendant, by deceiving the victim as above, received 43,000 won from the K Bank account (L) in the name of the Defendant from the victim, from the victim, and thereafter, received a total of 403,000 won from the victims through the above six times in total from December 25, 2018, as shown in attached Table 2 of Crimes List 2.
