1. The Defendant shall pay to the Plaintiff KRW 202,234,592 and the interest rate of KRW 15% per annum from April 20, 2017 to the date of full payment.

1. Facts of recognition;

A. The Plaintiff is a merchant who engages in the business of manufacturing the interior scenery, etc. with the trade name of “C,” and the Defendant is a merchant who engages in sales business with the trade name of “D.”

B. The plaintiff and the defendant have been engaged in transactions from time to time when the plaintiff supplied goods, such as Ansan test, to the defendant.

C. As of August 30, 2012, the Defendant supplied the goods from the Plaintiff, but did not pay or paid only part of the goods, and the unpaid goods that the Defendant had to pay to the Plaintiff was KRW 463,311,862.

On September 25, 2012, the Plaintiff received only KRW 200 million out of the above money between the Defendant and the Defendant, and the remainder paid to the Plaintiff at a discount, with the goods price to be paid by the Defendant to the Plaintiff.

E. Since then, the Plaintiff continued to supply goods to the Defendant and was paid some of them. The unpaid amount of goods to be paid by the Defendant as of January 10, 2017 is KRW 202,234,592, including the said KRW 200,000.

2. According to the above facts of recognition as to the cause of claim, the defendant is obligated to pay to the plaintiff 202,234,592 won and damages for delay calculated at the rate of 15% per annum from April 20, 2017 to the day of complete payment, which is the day following the day when the original copy of the instant payment order for which the plaintiff seeks performance was served to the defendant.

3. It is so decided as per Disposition by the assent of all participating Justices on the ground that the plaintiff's claim is justified.
