A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On April 30, 2014, the Defendant was sentenced to eight months of imprisonment with prison labor for obstruction of performance of official duties, etc. by the Chuncheon District Court, and completed the execution of the sentence on July 16, 2014.

1. On August 19, 2014, at around 17:45, the Defendant had been engaged in the performance of official duties regarding the handling of the 112 reported case, and received 112 reports from “D” front of “D” located in Chuncheon-si, Chuncheon-si, and had been able to look at the E Zone Assistant F for the Chuncheon Police Station.

이에 피고인은 112신고 사건 처리를 하던 F에게 다가가 같은 날 피고인에게 음주소란 행위로 통고처분한 것에 대해 따지며 “이 새끼야 내가 뭘 잘 못했어”라고 하며 오른손 손가락으로 F의 가슴을 3～4회 찌르고, 그 모습을 촬영하던 휴대폰을 내리쳐 땅바닥에 떨어뜨리게 하였다.

Accordingly, the Defendant interfered with the F’s legitimate execution of duties concerning the handling of 112 reported cases.

2. 112순찰업무에 대한 공무집행방해 피고인은 2014. 8. 19. 18:05경 제1항 기재와 같은 장소에서, 위 F에게 “배 째라고, 아니 데려다달라고, 경찰서”라고 말하며 통고처분에 대한 이의를 제기하여, F와 함께 112순찰차에 탑승하여 춘천경찰서로 가던 중 F에게 “이 개새끼야 너 아까 거기서 내 다리 깠지 내 무릎 이렇게 다쳤네. 너 고소할 거야”라고 말하고, 계속하여 같은 날 18:20경 춘천경찰서 정문 앞에 도착하여 내린 후 112순찰을 위해 지구대로 복귀하는 위 112순찰차의 앞을 갑자기 가로막고 보닛 위로 올라가 F에게 “내 가방 가져와 씨발놈아. 이 개새끼야. 니들이 경찰이야. 고소할거야”라고 말하며 F가 피고인을 때린 사실이 없음에도 F가 폭행하였으니 고소하겠다고 F를 협박하였다.

Accordingly, the Defendant interfered with the lawful performance of duties by F concerning 112 patrols by the above method.
