1. On the Plaintiff (Counterclaim Defendant),
A. Defendant B’s KRW 194,965,032 and its related thereto from October 27, 2012 to May 14, 2014
Reasons
1. Facts of recognition;
A. On February 9, 2012, the Plaintiff (Counterclaim Defendant; hereinafter “Plaintiff”) and the Defendant B entered into a contract for construction works, etc. between the Plaintiff and the Plaintiff (hereinafter “Plaintiff”) for the purpose of construction works, etc., the Plaintiff is a company that operates the factory under the trade name “E,” and the construction work that newly constructs “A” a factory building on three parcels, including Defendant B and Kimpo-si, Kimpo-si. (hereinafter “A Dong New Construction Work”).
A) The contract was entered into, and the main contents are as follows. The construction name is as follows: the construction area of the general factory construction (change): 1,408.75 square meters (426 square meters): the contract amount by September 30, 2012: 615,000,000 won (excluding value-added tax; hereinafter the same shall apply): the separate amount of value-added tax, unless there is any special entry therein.
(2) On May 2, 201, 200, 200,000 won for the first intermediate payment of KRW 100,000,00 for the second intermediate payment of KRW 100,00 for the second intermediate payment of KRW 100,00 for the second intermediate payment of KRW 215,00 for the remainder payment upon completion of the printing team work: 1/1,000 for each payment for delay at completion of the completion inspection; and on May 2, 2011, the Plaintiff entered into a contract with Defendant B for the construction of the “D factory operation building” on the above G and five lots (hereinafter “H construction”), and the main contents are as follows.
The name of a construction project: The construction period of 2,755.3 square meters ( around 835 square meters): 1,318,000,000 won for the contract amount: 1,000 won for the contract amount: 5,000,000 won for the first intermediate payment at the time of conclusion of the contract, and 300,000 won for the second intermediate payment of 300,000,000 won for the second intermediate payment of November 30, 201; 418,000,000,00 won for delayed payment from the end of the completion of the completion of the construction inspection: 1/1,000 to the end of the construction period of December 31, 201; 1,18,000 won for delay payment of the contract amount of the said new construction work; 1,000,000 won for the second intermediate payment of construction expenses; 20,000 won for the remainder payment of construction expenses;
