Reasons
Punishment of the crime
The Defendants received a proposal from the name and non-scambling (hereinafter “Scam”) organization (hereinafter “Scing”) that “If the Defendants would withdraw money from the given account and deposit money to the designated account, the Defendants would have an amount equivalent to 10% of the amount that would be withdrawn from the fee,” and conspired to receive 10% of the amount that was withdrawn in return, with the knowledge of the fact that the money withdrawn was related to the scaming fraud, upon receiving the instructions from the “H,” and received the instructions from the scambing staff in the designated place, to take over another’s passbook or scam card from the scambling staff or to withdraw the amount of damage deposited by the said passbook or scambing victims.
1. Defendant A
A. A. On January 16, 2015, the employee of the Defendant: (a) posted a false statement that he/she would sell DNA chere on the Internet Niberian website; (b) sent a false statement to the victim I who reported and contacted the false statement that he/she would sell the chere in KRW 1.2 million; and (c) then, he/she had the victim deposit KRW 1,200,000 with the national bank account in the name of J (K) in the name of J; and (d) the Defendant withdrawn it with the direction of “H” from January 21, 2015 to January 21, 2015; and (e) withdrawn KRW 13,710,000 over seven occasions in total, as indicated in the attached list of crimes.
As a result, the Defendant, in collusion with H “H” and a staff member of scaming operations, by deceiving the victims, acquired a total of KRW 13,710,000 by deceiving the victims.
B. (1) On January 21, 2015, the Defendant received the Cock Card (Consolidated Account Number: M) from Kwikset service article in the subway entrance area of Jung-gu Seoul, Seoul, and on the same day, deposited in the connection account by N, the victim of Bosing from the connection account.
