A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

1. 공무집행방해 피고인은 2020. 5. 24. 15:05경 의왕시 B에 있는 피고인의 어머니 C의 D아파트 E호 현관문 입구에서 위 C과 말다툼을 하고 행패를 부리며 집을 나가지 않아 C의 112신고를 받고 출동한 경찰관들이 피고인에게 퇴거를 요청하자, 의왕경찰서 F파출소 경장 G(남, 29세)의 얼굴을 주먹으로 1회 때리고 손톱으로 팔을 할퀸 후 발로 다리 부분을 1회 차고, 이를 제지하는 H팀 경사 I(여, 26세)의 다리를 발로 1회 차고 손으로 허리를 1회 꼬집고, 위 H팀 순경 J(남, 36세)이 이를 말리자 손톱으로 위 J의 손등을 할퀴었다.

After that, while the defendant was arrested in flagrant offender due to the crime of obstruction of performance of official duties, the defendant obstructed the legitimate performance of duties by the police officer on one occasion in the above D Apartment Kdong elevator.

2. On May 24, 2020, the Defendant: (a) was examined in the 10 king Police Station L and the fact-finding (2) of the king-ro L and the 10 king-ro of the king-ro of the 18:15 on May 24, 2020; (b) was examined in relation to the above obstruction of performance of official duties; and (c) during the inspection of the suspect interrogation protocol, the Defendant did not record the suspect interrogation protocol as the public document prepared by the king Police Station M assistant N,

Accordingly, the defendant has impaired the utility of documents, other articles, or special media records, such as electronic records, used by public offices.
