Reasons
Punishment of the crime
[Criminal Records] Defendant A was sentenced to six months of imprisonment with labor for a violation of the Act on the Punishment, etc. of Acts of Arranging Sexual Traffic at the Gwangju District Court on September 1, 2017 and the judgment became final and conclusive on December 1, 2017.
[2] Defendant A and Defendant B leased the 1st floor of the building located in Gwangju Northern-gu G, and established 80 units of “H” game, and operated the game room for “H” as a club business. Defendant C used the above game room as a business.
1. Joint crimes committed by Defendant A and Defendant B
(a) No free game-related business entity shall allow a game provider to play gambling or perform other speculative acts using game water or leave the game to do so;
Nevertheless, the Defendants conspired, from December 8, 2016 to June 21, 2017, to receive money from the said game room and the above game room, the Defendants entered points equivalent to the amount of money into the game machine, and received a request from the customers for return of the points obtained or lost through the game, and then issued a bearer free-use voucher (hereinafter referred to as 'the so-called ‘the so-called ‘the so-called ‘the so-called ‘be-called â’) per full score 1 out of the score, and subsequently, issued the said right to use free-of-charge by allowing customers to put the full score in the game machine so that they can play the game again, and make the said right to use free-of-charge by allowing customers to exchange the said right to use in the game machine and by allowing them to exchange the said free-use voucher at KRW 9,000 per full score 1 in the above game
As a result, the Defendants conspired to commit gambling or other speculative acts using game water, and caused the Defendants to do so.
(b) No one shall engage in the business of exchanging or arranging exchange or re-purchase of tangible or intangible results obtained through the use of game water;
Nevertheless, the Defendants conspired to exchange free vouchers with C, etc. at the time, place, etc. described in paragraph 1.
