Reasons
Punishment of the crime
[criminal record] On September 7, 2016, Defendant A was sentenced to one year and two months of imprisonment for a crime of fraud at a flood control center. Defendant A was released on December 23, 2016 during the execution of the sentence, and the parole period passed on April 3, 2017.
[Criminal facts] 2017 Highest 3939
1. On April 12, 2017, the Defendants conspired to obtain money from many unspecified victims in the name of the cost of goods through the commission of the Internet goods fraud. On April 13, 2017, the Defendants connected the Internet site “NV Gaff” and posted a false statement to the effect that Defendant A sells golf products on the Internet bulletin board, and Defendant B contacted the victim E who reported the above writing to the effect that “on the first hand transfers the price of goods, he would send golf bonds without molding it.”
However, the Defendants did not have the above golf loans, and even if they received money from the injured party, they did not have the intent or ability to deliver the golf loans.
As above, the Defendants: (a) by deceiving the victim; (b) received 200,000 won from the injured party to the Nonghyup Bank account in Defendant B’s name; and (c) from that time, transferred 8,540,000 won in total over 30 times in the same manner as indicated in Attached 1 Crime List No. 14-43, May 14, 2017.
2. On February 19, 2017, Defendant A’s sole criminal defendant posted a false statement to the effect that, at the Defendant’s home located in Young-si, F, 204 Dong 1407, the wife population F, and 207 Dong 1407, Defendant A visited the Internet site “On the Internet site,” and sold a golf machine on the bulletin board, and that, on the one hand, Defendant A reported the false statement to the effect that “on the other hand, the Defendant would send a golf machine without covering the golf machine” to the victim G who visited the Defendant.
However, the defendant did not have the above golf balls.
