Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant of "2019 Highest 1243" is a user who operates the food manufacturing business by employing 25 full-time workers as an operator of Gyeongbuk-gun B Co., Ltd. in Gyeongbuk-gun.

1. When a worker dies or retires, the employer in violation of the Labor Standards Act shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

From January 3, 2018 to January 31, 2019, the Defendant did not pay 10,408,060 won, including wages of 2,700,000,000 to retired workers D, within 14 days from the date of retirement without an agreement on the extension of the due date, and did not pay 24,50,060 won, in total, to 3 workers retired while working in the same workplace as indicated in each of the following list of crimes:

2. An employer who violates the Guarantee of Workers' Retirement Benefits Act shall, in case where the worker dies or retires, pay the retirement allowance within fourteen days after the cause for such payment occurred; and

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

The Defendant did not pay KRW 2,88,680 of retirement pay to employees D, who worked from January 3, 2018 to January 31, 2019, and KRW 1,503,790 of retirement pay to employees F, who worked from January 13, 2018 to January 31, 2019, within 14 days from the date of retirement without any agreement on extension of the due date.

The defendant of "2019 Highest 1614" shall North Korea.
