Reasons
1. Facts of recognition;
A. The defendant is a corporation established with the purpose of supporting projects related to the promotion of national sports, the improvement of the level of sports games and the fostering of juveniles, and the creation, operation, and management of funds for conducting projects related to the promotion of sports science and research in Seoul Olympic Games. 2) The defendant divided the occupational group into general service, research service, management service, and contract service (annual salary contract, support service, and work contract) and hires workers. From among the 574 Plaintiffs, 574 Plaintiffs A, B, D, D, E, F, H, G, H, I, K, L, M 13 (hereinafter “operating Plaintiffs”), and the rest of 561 Plaintiffs (hereinafter “the Plaintiffs for work for support”).
B. The Defendant’s provision related to the Defendant’s remuneration and various allowances provides that “the Regulations on the Employee’s Annual Salaries” as the provision on remuneration for general service, research service, and the provision on the appointment and remuneration for management service, and that “the Regulations on the Enforcement of the Employee’s Salary Regulations (hereinafter “Rules on the Management Service”) provides for “B” as the provision on the appointment and remuneration for contractual service, and Article 4 of the Regulations on the Enforcement of the Contract Employee’s Salary Regulations (hereinafter “Rules on the Management Service Regulations”) applies mutatis mutandis to matters concerning the remuneration, calculation, and payment of management service. In addition, the specific provision on the performance-based system provides for the operation of the performance-based welfare system (hereinafter “the Regulations on the Performance-based Salary Regulations”) as the specific provision on the selective welfare system, and provides for the management guidelines for the support service among contractual service (hereinafter “the Regulations on the Management Service Personnel”) as the specific provision on the appointment, remuneration, etc. of contractual service, each of the Regulations on the Management Service Employee’s Guidelines on the Management Service Workers.
The guidelines for the personnel management of support workers and the guidelines for the daily workers shall not exceed the guidelines.
