The appeal is dismissed.

The grounds of appeal are examined (to the extent of supplement in case of supplemental appellate briefs not timely filed).

In examining the record, the first instance court and the lower court did not err by infringing the Defendant’s right to defense or the right to equality, as otherwise alleged in the grounds of appeal.

In principle, the adoption of the application for examination of evidence falls under the discretion of the court, and thus, the court below's rejection of the defendant's application for examination of evidence cannot be deemed unlawful.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
