Punishment of the crime

【Criminal Facts】

1. On May 7, 2014, the Defendant, who driven a drinking or non-driving license twice or more as above, once again, driven B car under the influence of alcohol with a blood alcohol concentration of about 0.222% at the 60 meters from May 7, 2014 to the first road of the Dong-dong, Young-dong, Young-gu, Chungcheongnam-gun, Chungcheongnam-do, which is a subsidiary road of the Dong-dong, Young-gu, Chungcheongnam-do, Chungcheongnam-do, and the road of the Dong-dong, which is a 600-meter road in the calculation of the Eup.

2. Driving without a license or unlawful display of official document on June 11, 2014;

A. On June 11, 2014, at around 00:16, the Defendant driven the car of the Karen-gu without obtaining a driver’s license in approximately KRW 500 meters section from the modern shopping road located in the center of the Dong-dong, Young-dong, Chungcheongnam-do to the central intersection located in approximately 35-1 in the center of the same Eup.

B. At the time stated in paragraph (1), the Defendant was required to present an identification card to verify the identity of a police officer D belonging to the Youngdong Police Station C District District, who was dispatched after receiving a report from a pedestrian and a trial member due to a violation of signal at the central intersection.

The defendant presented a driver's license to E, which is an official document issued by the Commissioner of the Chungcheong Police Agency, who was in the custody of Mab, to the above police officer as if he was a driver's license for the defendant himself.

Accordingly, the defendant did not exercise his driver's license, which is an official document.

3. On June 23, 2014, the Defendant’s driving without a license is the same Eup/Myeon in front of the Young-dong Elementary School located in two-lane 47, Dong-dong, Young-dong, Chungcheongnam-dong, Chungcheongnam-dong, Chungcheongnam-do, Seoul, around 20:50 on June 23, 2014.
