Reasons
Punishment of the crime
From March 6, 2015 to April 8, 2015, the Defendant embezzled the materials of the total amount of KRW 13,436,200 owned by the victim for five times as follows, while managing the materials of the victim’s ownership at the site of “D” located in Incheon Cheongjin-gun, Incheon, and by obtaining a subcontract from the victim E, and managing the figures at the site of the said construction.
1. On March 6, 2015, the Defendant, at the site of “D” construction site located in Incheon Cheongjin-gun, Incheon, and at the site upon receiving a subcontract from the injured party for the construction, and stored materials of construction, such as 11,196,200 won of the market price owned by the injured party, and used the erop, erop, erop, erop, erop, erop, erop, erop, etc., and embezzled the leased materials owned by the injured party at his/her discretion at the time of Gyeonggisan-si.
2. On March 23, 2015, the Defendant, at the site of “D” construction around March 23, 2015, stored construction materials owned by the victim and embezzled the said construction materials owned by the victim at his/her own discretion at the site of the Incheon Yongdo Corporation, which amounting to KRW 480,00,000, in total, to KRW 200, market price of KRW 200,000, and KRW 200,000.
3. On March 31, 2015, the Defendant, at the site of “D”, stored construction materials worth KRW 470,000,00 in total, including 130,000,000 from the victim’s market value (400,1200), 10,000, and 10,000 of the market value (30,140,000, 140,000, and 10,000,000 of the market value. At around that time, the Defendant arbitrarily embezzled the victim’s construction materials owned by the Plaintiff to the field of the Incheon Island.
4. The Defendant, at the site of “D” construction around April 4, 2015, stored materials equivalent to KRW 360,000, totaling of 150,000 (500X1200) and 15,000 (15,000) of the market value of the victim’s ownership at the site of “D” construction work.
