The defendant's appeal is dismissed.

1. The decision of the court below on the summary of the grounds for appeal (three million won of fine) is too unreasonable.

2. The judgment that the defendant recognized the crime of this case and reflects his mistake, that the defendant is aged and is faced with the situation that is currently economically difficult, etc. However, it is not easy to agree with the victim in light of the circumstances favorable to the defendant, or the degree of injury of the victim caused by the defendant's crime. Nevertheless, it does not yet reach an agreement with the victim. The defendant has been punished several times for the same kind of crime before, in particular, the defendant committed the crime of this case during the suspension period of execution due to the same kind of crime, and in consideration of the motive and circumstance of the crime of this case, the circumstances after the crime, the defendant's age, character and conduct, and environment, and other various circumstances that are the conditions for sentencing specified in the records and arguments of this case, the sentencing of the court below is not heavier.

3. The defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the defendant's appeal is without merit. It is so decided as per Disposition.
