The defendant's appeal is dismissed.

1. The summary of the grounds for appeal is that the Defendant’s vehicle cannot conflict with the victim’s vehicle as it is in the signal atmosphere at the location of U.S., and the victim’s statement made by C is false and the black image was also fabricated.

Therefore, the lower court erred by misapprehending the legal doctrine on the facts charged of this case.

2. In full view of the following circumstances acknowledged by the evidence duly adopted and examined by the lower court, the fact that the collision between the victim’s vehicle and the pentar is sufficiently recognized in the course of moving the vehicle to the U.S. branch.

Therefore, the judgment of the court below which found the defendant guilty of the facts charged of this case is just, and there is no error of mistake of facts as alleged by the defendant.

가. 이 사건 당시 피해자 차량에 설치되어 있는 블랙 박스에 찍힌 동영상 영상 CD에는 Rec_20191122 _143545 _D .avi 와 Rec_20191122 _143645 _D .avi 두 개의 영상이 있고, 위 영상들은 전방 영상과 후방 영상이 함께 포함되어 있는데, 동영상 재생 프로그램인 ‘ 팟 플레이어’ 로 재생하면 피해자 차량 블랙 박스의 전방 혹은 후방 영상이 재생되고, 팟플레이어의 좌측 상단에 있는 ‘ 팟 플레이어’ 라는 메뉴 선택 영역을 클릭하여 그 메뉴 중 ‘ 영상/ 영상선택 ’으로 들어가게 되면 다른 영상을 선택할 수 있다.

(B) The following facts are recognized:
