A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person who operates the “E” as a manufacturer and processing company of food located in Kimpo-si D.

1. No person who violates the Food Sanitation Act (Prohibition of False Labeling, etc.) shall make any false, exaggerated, or slanderous labelling or advertisement that falls under labels, advertisements, etc. that are likely to deceive, mislead, or confuse consumers with respect to the names, manufacturing methods, quality, nutrition labelling, genetically modified foods, etc., and food traceability labelling;

가. 피고인은 2013. 10. 7.부터 2015. 4. 6.까지 위 E에서, 거래처인 ‘F’ 등으로부터 냉동 뽕잎 냉면 등을 납품해달라는 요청을 받고 이미 유통기한이 지난 위 냉동 뽕잎 냉면 등의 유통기한을 2013. 10. 7.부터 2015. 4. 6.까지로 허위로 기재하는 방법으로 별지 범죄일람표 2 기재와 같이 냉동 뽕잎 냉면 등 5,625,000원 상당의 제품의 유통기한을 허위표시하였다.

나. 피고인은 종업원인 G, H와 공모하여 2015. 3. 26.경 위 E 내에서, 유통기한이 2014. 10. 30.로 이미 그 기한이 경과된 뽕잎냉면 6박스 15킬로그램 및 메밀냉면 7박스 15킬로그램의 각 유통기한을 2015. 5. 30.로, 유통기한이 2014. 8. 30.로 이미 그 기한이 경과된 함흥냉면 11박스 15킬로그램의 유통기한을 2015. 5. 16.로 별지 범죄일람표 3 기재와 같이 각 허위표시한 포장용기에 옮겨 담아 재포장하는 방법으로 유통기한을 허위표시하였다.

2. Violation of the Food Sanitation Act (quality control and report);

(a) A business operator who manufactures or processes foods or food additives and his/her employees shall not display, keep or sell foods or food additives for sale purposes, or use such foods or food additives for manufacturing or processing, if they have expired for raw material management, manufacturing process, or sanitary control of foods, etc.;
