피고인은 2012. 3.경부터 2013. 8. 30.경까지 자신이 운영하는 농업회사법인 C 주식회사 인터넷 홈페이지(D)에 E 분말제품을 광고함에 있어 원료인 돼지감자에 포함된 이눌린에 대하여 “영양학자인 F는 돼지감자 주성분인 이눌린을 천연이눌린이라고 극찬하였습니다. 당뇨! 관절염! 이젠 걱정 그만!!! G 농원의 돼지감자로~”라는 문구를 게시하여 의약품과 혼동할 수 있는 허위과대 광고를 하였다.
