Reasons
Punishment of the crime
1. Defendant A indirect subsidy program operator shall implement an indirect subsidy program with due care as a good manager according to statutes and the purpose of granting indirect subsidies, and shall not use such indirect subsidy for any other purpose;
Nutrition Group received a national subsidy of KRW 30 million from the Ministry of Environment as a subsidized project operator of the project to support natural ecosystem conservation activities conducted by the Ministry of Environment through Gyeongbuk-do. On November 14, 2013, "G Village Association (H)", the Defendant’s representative, applied to the Nutrition Group for the payment of KRW 30 million for the project, such as the installation of natural reservoirs and landscaping trees, and accordingly, the dietitian group selected the aforementioned Village Association as a subsidized project operator around November 18, 2013.
On November 25, 2013, the Defendant received KRW 30 million from Nutrition Group to the account under the above H’s name for indirect subsidies. As such, the Defendant initially used KRW 22 million for the purchase and planting of landscape trees in accordance with the plan at the time of the initial application for subsidies and used the indirect subsidy of KRW 180,000 in total, including KRW 180,000,000,000 for the purchase of trees for personal use and KRW 250,000,000,000 for the purpose of other purposes.
2. Defendant A and Defendant B entered into a contract on November 20, 2013 with Defendant B, the representative of C Co., Ltd., to establish five small beams and lawsuits with respect to J, a small river in nutrition and management of Gun I located in Gyeongbuk-do.
Although a person who intends to construct small river appurtenances, etc., he/she shall obtain the permission of the head of Gun with nutrition, the Defendants shall collect the rocks and earth and rocks from around November 25, 2013 to December 5 of the same year from around December 2013 without obtaining the permission and collect them from the above J to cut off the rocks and earth and rocks from the above J, and use them such as raw trees (a height of about 1m, about 20m in length).
