1. 피고인들의 공동범행{폭력행위등처벌에관한법률위반(공동폭행)} 피고인들은 2014. 10. 25. 21:40경 제천시 D 인근에 있는 E 편의점 앞 노상에서, 길을 지나가던 피해자 F(20세), 피해자 G(20세), 피해자 H(21세)이 피고인들을 쳐다보았다는 이유로 피고인 A는 “뭘 봐, 씹할 놈아”라는 등의 욕설을 하며 피해자들에게 계속 시비를 걸어 이에 피해자들이 피고인 A를 피해 도로 건너편으로 건너가면서 피해자 F이 그 뒤를 계속 따라오는 피고인들에게 “가세요”라고 말을 하자, 갑자기 피고인 B는 피해자 F에게 “너 지금 뭐라고 했어”라며 주먹으로 위 F의 가슴 부위를 4회 때리고 손으로 피해자의 목을 1회 때리고, 이를 말리는 피해자 H의 멱살을 잡아 2~3회 흔들고, 피고인 A는 이에 합세하여 한 손을 펴서 엄지와 검지 손가락 사이로 피해자 F의 목 부위를 1회 때리고, 계속하여 피고인 B는 휴대전화로 신고하려는 피해자 G의 멱살을 잡아 흔들고 손바닥으로 위 G의 뺨을 3회 때리고, 피고인 A는 위 G의 멱살을 잡아 수회 흔들고, 발로 위 G의 왼쪽 허벅지 부위를 1회 찼다.
