A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

1. Interference with business;

가. 피고인은 2014. 8. 13. 21:48경 제주시 C에 있는 ‘D’에서, 술에 취한 상태로 찾아가 매니저인 피해자 E에게 “술을 갖고 와, 사장 불러와 새꺄”라는 등의 온갖 욕설을 하고 주점 내 여기저기를 돌아다니면서 테이블에 있는 유리컵을 던져 깨트리고 윗옷을 벗어 상체의 문신을 보이면서 손님들이 술을 마시고 있는 테이블에 들어가서 성명불상의 남자 손님의 머리채를 한 손으로 잡고 한 손으로 얼굴을 때려 술을 마시던 손님들이 시끄러워 술을 못 마시겠다며 나가버리게 하는 등 약 1시간에 걸쳐 위력으로 피해자의 주점 영업 업무를 방해하였다.

나. 피고인은 2014. 12. 23. 03:50경 위 ‘D’에서, 술에 취한 상태로 찾아가 술을 주문하였으나 매니저인 피해자 위 E가 “너무 시간이 늦었고 술이 취해 술을 줄 수가 없다”라고 하자 험상궂은 인상을 쓰면서 “이 가게 다 엎을 수 있다, 술 갖고 와”라고 말하고 온갖 욕설을 하면서 행패를 부려 술을 마시던 손님들이 술을 더 마시지 못하겠다며 나가버리는 등 약 30~40분에 걸쳐 위력으로 피해자의 주점 영업 업무를 방해하였다.

2.
