Reasons
Punishment of the crime
1. Defendant A and Defendant B’s joint criminal act knew that they could have contacted with taxi engineers who want to sell lost goods loaded on a cell phone (one-name “scambing”) following the use of a mobile phone set in front of a high-speed bus terminal, with the intent to purchase and sell a cell phone, which is a stolen, by the aforementioned method.
On November 21, 2015, at around 00:0 to 03:00, the Defendants contacted with a taxi engineer with the 138-dong-gu Dong-dong-gu 138-ro, Daegu-dong-dong-gu, Daegu-gu, where the names cannot be known by the means of trace, and acquired stolen goods by purchasing three cell phoness, including gallon 3,500,000 won in total, from around that time to December 5, 2015, with the knowledge of the fact that the stolen goods are stolen, including gallon gallon 3,5,000 won in total, from around nine times in total, from around that time to around December 5, 2015.
The Defendants conspired to acquire stolen goods as above.
2. On November 17, 2015, the Defendant: (a) received a request from friendly job offer B to sell a cell phone, which is a stolen product purchased from a taxi engineer who could not know his name in the Daegu Si-si; and (b) accepted it.
On November 21, 2015, the Defendant: (a) issued a bus terminal in Daegu-gu Dong-gu, Daegu-gu, 138 high-speed bus terminal; (b) sent a cell phone to a designated location by a stolen business operator (one-name “E”); (c) confirmed the invoice number; (d) received 370,000 won of the cell phone price from the above physical business operator to the Defendant’s account in the name of the Defendant; and (e) transferred 300,000 won of the cell phone price to the national bank account in the name of F used by B from around that time to December 5, 2015; and (e) sent the cell phone price to the national bank account in the name of F from that time to December 5, 2015.
