피고인은 2017. 10. 17. 03:50 경 포항시 북구 B에 있는 'C 주점' 앞길에서 위 주점에서 술에 취해 소란을 피운 것을 이유로 경범죄 통고서를 발부 받자 화가 나 " 이 씨 발 내가 뭘 잘못 했노. "라고 욕설하면서 포항 북부 경찰서 죽도 파출소 소속 순찰차의 뒷부분에 세워 져 있는 무전기 안테나를 오른손으로 잡고 휘어 뜨려 280,500원 상당의 수리비가 들도록 공무소에서 사용하는 물건을 손상하였다.
