Reasons
Punishment of the crime
[Criminal record] On April 4, 2013, the Defendant was sentenced to two years of imprisonment for a violation of the Punishment of Violences, etc. Act (a group, deadly weapon, etc.) at the Busan District Court, and completed the execution of the sentence on October 25, 2014.
[Criminal facts]
1. On September 26, 2016, at around 18:00, the injured Defendant: (a) laid the CCTV installed in the victim D’s house located in 203 Dong-dong 119, Busan Youngdo-gu, Busan, 2016; (b) moved the victim’s two arms into the victim’s hallway stairs of the 1st floor 203 Dong-dong 203; (c) moved into the victim’s left part of the victim’s hallway; (d) 2 times in drinking, the victim’s knee kne kne kne kne kne kel kel knife knife knife knife knife knife knife knife knife knife knife knife knife knife knife knif knif.
2. On March 9, 2017, the Defendant used computers and others, etc.: (a) had the victim’s cell phone known from the victim’s house set forth in paragraph (1) to his own seat in the same type as that of the Defendant’s cell phone; and (b) had the victim’s cell phone known from the victim’s house to his own seat; and (c) had the victim’s cell phone used
On March 10, 2017, around 01:22, the Defendant settled a video service of an amount of KRW 4,500,00 on the screen that the fee for video service is added to the fee for handphones following the following month, by linking the Defendant’s house located in Busan Young-do E apartment No. 203 Dong 108, 203, and 108, with the aforementioned mobile phone No. 107, the Defendant’s cell phone No. 200,000, to the “video PortTV,” and putting a pre-established payment password, and then, entering the payment password, the Defendant settled the video service of an amount of KRW 4,500,00 on the screen that the fee for video service is added.
The Defendant, as such, entered information into a computer or any other information processing device without authority, thereby receiving a fee of KRW 4,500 from the damaged party for fee of KRW 4,500, a fee for video portal TV.
