Defendant
A and B shall be punished by imprisonment with prison labor for ten months, and by imprisonment with prison labor for eight months.

Reasons
Punishment of the crime
Defendant
A is the vice president of the North-gu, Northern-si, and the defendant B is a person who runs the bathing business with the trade name of G, and the defendant C is the representative director of H who runs the construction business.
In constructing a community hall at the port of port, the construction business operator was selected by a free contract and the victim was paid 90 million won or more of the total project cost in order to be paid 30% or more of the total project cost. The Defendants prepared a contract as if the construction cost between F and H is KRW 130 million (the total amount of KRW 40 million, KRW 90 million, and KRW 90 million) between F and H around June 2012, and Defendant B paid KRW 40 million to Defendant A with the appearance of KRW 40 million, including that Defendant A had the self-paid 40 million from F, and in fact, Defendant B intended to receive only KRW 90 million as the construction cost.
On June 2012, the Defendants: (a) at the Spatial Building Office of Co., Ltd., Ltd., Ltd., located in the 2nd parallel of the deathdo of North Korea at the port of Posi; (b) at the Posi-gu, North Korea-gu, North Korea-gu, and the contract amount for construction of the F community hall; and (c) between F and H, which caused KRW 130 million to the contract amount; (d) around June 20, 2012, Defendant B remitted KRW 40 million to the account of the community credit cooperatives in the name of Defendant A; and (e) Defendant A transferred KRW 40 million to the account of his own name.
Defendant
A, around June 25, 2012, when applying for a subsidy to the Autonomous Administration Department of the North-gu Office of North Korea at the port, it seems that A submitted a copy of the above Agricultural Cooperative Account, stating the plan for the construction of community hall, the above contract, and the deposit deposit amount of KRW 40 million, which is stated as “the project cost of KRW 130,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000.
