A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On April 20, 2012, the Defendant was sentenced to ten months of imprisonment for fraud at the Incheon District Court, which became final and conclusive on June 12, 2012.

The defendant is the actual operator of D Co., Ltd. in Seo-gu Incheon Metropolitan City.

1. On June 17, 2010, the Defendant issued a false tax invoice in collusion with E representative director of D, and around June 17, 2010, the Defendant issued a false tax invoice stating that “A supplier, supplier, supplier, scarting power company, supply price of KRW 20,334,00, item street lamps, and item street lamps.”

In collusion with the above E, the Defendant did not supply goods or services as shown in the attached list 1 from June 17, 2010 to April 30, 201, and delivered an amount equivalent to KRW 698,553,000 in total of the supply value of the false tax invoice 14 from June 17, 201 to April 30, 201.

2. On July 29, 2010, the Defendant received a false tax invoice in collusion with E’s representative director, and around July 29, 2010, under which there was no fact that the Defendant leased equipment or received office construction services from the friendly aggregate industry at the office of the said D Co., Ltd., the Defendant received a false tax invoice stating “D, supply price of 50,410,000 won, product rental, and office construction services”.

In collusion with the above E, the Defendant did not receive goods or services as shown in the attached Table 2 from July 29, 2010 to October 31, 2010, and received from each transacting party an amount equivalent to KRW 625,260,000 in total of the supply value of the false tax invoice 6.
