[Case of Fraud] Defendant shall be punished by imprisonment with prison labor for six months.

Provided, That the above punishment shall be imposed for two years from the date this judgment became final and conclusive.

Punishment of the crime

[2014 Highest 5650] On April 26, 2012, the Defendant was sentenced to a suspended sentence of imprisonment with prison labor for four months at the Incheon District Court on April 26, 2012, and the said judgment was finalized on May 4, 2012.

On March 31, 2012, the Defendant made a false statement that “it is necessary to have a mining right in strings, and money is required to pay mine permission. If the Defendant borrowed KRW 10 million, it will complete payment after two weeks,” at the office of the victim D in Jung-gu Incheon Metropolitan City, Jung-gu.

However, in fact, the Defendant had a debt equivalent to KRW 55 million to the victim with bad credit standing, and around June 201, there was no economic situation such as borrowing KRW 50 million to E, and there was no intention or ability to use the entire amount received by the victim as expenses for permission for mining, or to repay it within the time limit.

Nevertheless, the Defendant, by deceiving the victim as such, received KRW 10 million from the victim on the same day.

1. On March 29, 2013, the Defendant issued a false tax invoice of KRW 451,294,140,00 in total, instead of supplying goods or services, at the G company’s office located in the Dong-gu Incheon Metropolitan City, notwithstanding the absence of the fact that the G company supplied goods or services to H company, the Defendant issued a tax invoice indicating the supplier’s “G company,” “H company,” “30,179,000,” “in the absence of a supply of goods or services,” “in the absence of a supply of goods or services,” “in the absence of a supply of goods or services,” “in the absence of a supply of goods or services,” “in the absence of a supply of goods or services,” “in the absence of a supply of goods or services,” the Defendant issued a false tax invoice of KRW 451,294,140 in the attached list No. 30, Dec. 30, 2013.
