Defendants shall be punished by imprisonment for six months.
However, the execution of each of the above penalties for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Defendant A
A. A thief (1) around 19:00 on June 20, 2014, the Defendant: (a) discovered that the victim H set up one set of LG options 2 smartphones on the ground of the market value of 980,000 won in the sobry area located in Seongbuk-gu, Sungnam-gu; (b) discovered that the victim H set up one set of LG options 2 smartphones on the ground of the market value; and (c) used a creb in the surrounding area without any limit to bring about one set of the above smartphones.
(2) At around 09:00 on July 9, 2014, the Defendant discovered that the victim K has set up one Samsung Ggalthol 3 smartphone and one wall in the market value of KRW 1080,000,000 in the PC room located in Seongbuk-si, Sungnam-si, and discovered that the victim K has set up one unit of Samsung Ggalthol 3 smartphone and one wall, and then cut off one unit of the victim’s community credit card, our bank, and one credit card of corporate bank, respectively, in the victim’s name.
(3) On July 11, 2014, around 07:39, the Defendant found at the PC bank located in Seongbuk-si, Sungnam-si, the Defendant: (a) discovered one bank containing the LG options chip mobilephone with which the market price of the victim M is unknown; (b) discovered one bank from which the victim M was locked on his/her book; and (c) using any cres outside the surrounding area, resulting in a theft of one and one bank from the above smartphone.
(4) On July 12, 2014, at around 10:30, the Defendant discovered that the victim’sO placed one Samsung Ggalthalian 1 smartphone, cash 10,000 won, and one wall containing a credit card in the victim’s name, etc., and cut off one of the above smartphones and one wall 1,000,000 won from the victim’s bank, etc. using any crebs outside the surrounding area.
B. Violation of the Specialized Credit Financial Business Act and fraud (1) Defendant is equivalent to KRW 337,000 at one market price in the Jung-gu P located in Sungnam-si P on July 9, 2014, and KRW 14 K goldb.
