A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

No person, other than a handler of narcotics of the 2017 Highest 3952, shall sell, administer, or possess the Meptopa (one philopon; hereinafter referred to as “philopon”), which is a local mental medicine, and no person shall possess marijuana for the purpose of smoking or smoking it, and the defendant is not a handler of narcotics.

1. On January 25, 2017, the Defendant: (a) decided to purchase a philopon from the seller of a mobile phone via “C”, which is a mobile phone; (b) deposited the price of KRW 800,000,000 into the National Bank account in the name of D; (c) sold a philopon by collecting approximately 0.8g of the philopon left by the said person in the name of Gangnam-gu Seoul, at around 23:50 on the same day; and (d) sold a philopon through collecting approximately 0.8g of the philopon left by the said person in the name of the mail box or the stairs rail; and (e) handled the philopon over 12 occasions from around that day to April 14, 2017, as indicated in the attached list of crimes.

2. Violation of the Narcotics Control Act;

A. Around April 4, 2017, the Defendant smoked marijuana in a manner of gathering and melting it in a pipe made of stuffed paper at the Defendant’s residence located in Dobong-gu Seoul Metropolitan Government, by inserting it into the pipe and attaching a fire to it.

B. On April 14, 2017, the Defendant, holding marijuana for smoking purposes, stored plastic containers containing approximately 2.95g of marijuana in shopping bags for smoking in around 00:41, and carried marijuana.

Although the Defendant is not a handler of narcotics, the Defendant, around July 6, 2017, sent KRW 800,000,000,000 to the account used by a person whose name is unknown, under the pretext of the price for Mepta (one penphone; hereinafter “philopon”), which is a local mental medicine, to the account used by a person whose name is unknown, and around July 22, 2017, around 22:00 of the Seoul Gangnam-gu Seoul Metropolitan Government (hereinafter referred to as “Blopon”), and sent approximately 1g of a philopon in a plastic wing box, which is contained in a plastic wing box, to the blopon.
