Reasons
Punishment of the crime
The defendant is a person who manages the game hall in the game room operated by D, such as recruitment and management of employees of the game room, surveillance and control of game machine installation and control, and payment of consideration to the president of the place of prompt name.
1. The crime committed on August 7, 2012;
A. The Defendant in collusion with D on August 7, 2012, from around August 7, 2012 to August 8, 2012, the Defendant established 33 square meters game machines in Gangnam-gu, Seoul, which did not receive classification in the game room, and provided 60 games for unspecified customers, and exchanged 10,000 won per 10,000 customers who completed the game with cash exchange.
In collusion with D, the defendant provided unclassified game products to customers for use, and exchanged tangible and intangible results obtained using game products.
B. On August 1012, 2012, the Defendant, along with D, stated that “On the first day of the early 2012 Police Station and intelligence team of the Seoul Southernbuk-gu, Seoul Northern-gu, I would operate an amusement room that our country would be subject to regulation because of operation of the amusement room. If the regulation is done, a fine will be given instead, and one million won will be paid every ten days, and if the case is resolved well, five million won will be paid separately from the consolation money. If the regulation is done, I would request the police to make a statement to the unemployment owner, and I would have consented to it as if it were the actual owner of the business.”
Accordingly, the Defendant conspiredd with D to induce criminal escape.
2. The crime committed on September 5, 2012;
(a) Where a person who violates the Game Industry Promotion Act intends to conduct a general game providing business, he/she shall provide game products the rating classification of which is completed after obtaining permission from the competent authority;
Nevertheless, the defendant conspired with D, from September 5, 2012 to the same year.
