가. 필로폰 밀수입 1) 피고인들은 중국에 거주하는 필로폰 밀수 총책 D의 지시로 인천공항을 통해 필로폰을 직접 밀반입하거나 운반책으로부터 필로폰을 건네받아 국내에서 필로폰을 판매하기로 상호 공모하였다. 피고인 B은 2016. 5. 28. 오전경 중국 텐진공항에서, D으로부터 전달받은 필로폰 약 20g이 든 비닐팩 1개를 팬티 속에 은닉한 채 E항공편을 이용하여 국내로 입국한 뒤 같은 날 11:15경 인천 중구 공항로 272 인천국제공항 입국심사장 검색대를 통과하는 방법으로 밀수입하고, 그 즉시 서울 영등포구 F공원 인근 상호불상의 호텔에 투숙중인 피고인 A에게 전달하였다. 이로써 피고인들은 D과 공모하여 필로폰을 밀수입하였다. 2) 피고인 A은 2016. 6. 1. 새벽경 중국에 거주하는 필로폰 밀수 총책 D으로부터 위챗을 통해 ‘필로폰 45g을 인천공항을 통해서 밀수하는데 B을 보내서 받으러 나오게 하고, 필로폰 운반은 G가 중국에서 인천공항으로 가지고 들어갈 것이다’라는 지시를 받고 그 지시내용을 피고인 B에게 전달하였고, 피고인 B은 인천국제공항 주차장에서 운반책 G를 기다렸다.
