Punishment of the crime

1. The Defendants’ co-principal

A. On November 15, 2014, the Defendants violated the Punishment of Violences, etc. Act (collective violence, deadly weapons, etc.) came to fall under the name-free customers who were next to the Defendants while drinking alcohol at the main points of “E” located in Busan Shipping Daegu D and the second floor around November 15, 2014, and thus, Defendant B was able to escape from disturbance, such as breaking an abruptive drinking.

Therefore, the victim F(39 years of age) who performed alcohol at the above main point was trying to file the said disturbance with the Defendants. However, Defendant B, under the influence of alcohol, threatened the Defendants with the view to “I wish to die” and “I want to die.” The victim asserted against the victim, and again, the Defendants b sponsed the victim’s breath, and Defendant B b sponsed the victim’s face while she got the victim from drinking.

As a result, Defendants conspired to commit violence against the victim while carrying dangerous objects.

나. 업무방해 피고인들은 제1항 기재 일시에 피해자 G이 운영하는 같은 장소에서 술에 취하여, 피고인 A은 옆 좌석에 앉아 술을 마시던 성명불상의 손님에게 다가가 아무런 이유 없이 손으로 툭툭 치면서 ‘한번 붙어보자는 거냐.‘면서 고함을 지르고, 피의자 B는 사기로 만들어진 빈 안주 접시를 들고 수회에 걸쳐 던지려는 시늉을 하다가 이를 그곳 테이블 위에 던져 깨뜨렸으며, 그 당시 주점 내 5-6명의 손님들에게 ’씹할 놈‘ 등의 욕설을 하였고, 피의자들은 제1항 기재와 같이 이를 말리던 F을 폭행하는 등 약 15분 동안 소란을 피웠다.

As such, the Defendants conspired to interfere with the victim's main business by force.

2. Defendant B sent to Busan who was reported by the Defendant and A at the above station around November 15, 2014, at around 00:55, and reported that the Defendant avoided disturbance.
