Defendant shall be punished by a fine of five million won.

Where a defendant fails to pay a fine, one hundred thousand won shall be the day.

Punishment of the crime

The Defendant is a person who operates F with the trade name “E” from May 2014 to April 2015 at the office located in Daegu Suwon-gu D and 3 floors.

1. No person who violates the Trademark Act shall use any trademark identical or similar to another person's registered trademark on goods identical or similar to the designated goods, and shall use it for the purpose of using it or for the purpose of having another person use it;

Nevertheless, from May 2014 to April 2015, the Defendant sold a total amount of KRW 5,17,500 in the market price of counterfeit goods, on which a trademark similar to each trademark design of the Korean Intellectual Property Office (MOSCHIN) registered with the Korean Intellectual Property Office, as shown in attached Table 1 draft table of crime No. 1, such as E, at the above office, from May 2014 to April 2015, and infringed the trademark right of the above registered trademark.

2. He/she shall not commit an act of causing confusion with another person's goods by using any other person's name, trade name, trademark, container or package of goods, or other goods identical or similar to another person's business mark widely known in the Republic of Korea, or by selling, distributing, importing, or exporting goods using such other person's business mark;

그럼에도, 피고인은 2014. 5. 경부터 2015. 4. 경까지 위 사무실에서, 온라인 매장인 F( 상호명: E) 을 통하여 별지 범죄 일람표 2 기 재와 같이 국내에 널리 알려 진 꼼 데 가 르 송 (Comme Des Garcons), 겐 조 (Kenzo) 상품 표지를 사용한 위조 상품 정품 시가 합계 82,356,700원 상당을 판매하여 꼼 데 가 르 송, 겐 조 정품 물건으로 혼동하게 하였다.
